Florida's Slip and Fall Laws
As an attorney with the law firm of Chavin Mitchell Shmuely in North Miami, FL, Rami Shmuely represents plaintiffs in a broad range of personal injury cases. In 2015, Rami Shmuely secured one of the year's largest statewide jury awards on behalf of a slip-and-fall client.
If a person suffers an injury on a property belonging to another individual or organization, the injured party may be able to secure compensation for medical expenses. In some cases, it could be necessary for the injured party to prove that the property owner and/or employees knew about the hazardous conditions that led to the fall. In some instances, the injured person's legal team must prove that the owner of the premises made a deliberate choice not to address the issue.
The court may also find that the plaintiff was partially at fault. Because Florida follows the pure comparative negligence rule, such a decision reduces the amount of compensation by the plaintiff's percentage of fault. For example, if the plaintiff is 20 percent at fault and the court grants a $100,000 award, that individual would receive $80,000.
